Terms of Service

These Terms of Service ("Terms") govern your use of Cardinkum ("Platform"), operated by Cardinkum Pty Ltd ("we", "us"). By accessing the Platform you agree to these Terms. If you do not agree, do not use the Platform. Questions: legal@cardinkum.com.au.

1. Use of service

  • The Platform is free to use for personal research and non-commercial purposes.
  • You must be 16 years or older to use the Platform.
  • You must not use the Platform in a way that violates Australian law or regulation.
  • You must not attempt to disrupt, overload, or interfere with the Platform or its infrastructure.
  • Scraping the Platform at scale without an API key is prohibited.

2. Data accuracy disclaimer

Vehicle specifications on the Platform are sourced from manufacturer websites, government publications, and community contributors. We publish this data in good faith and make reasonable efforts to ensure accuracy.

Data is provided "as is" without warranty of any kind. Vehicle specifications, prices, and running costs may change at any time. Always verify specifications directly with the manufacturer or dealer before making a purchasing decision.

We accept no liability for decisions made on the basis of data published on this Platform.

3. API usage terms

  • API access is free for personal, research, and non-commercial developer use.
  • Commercial use (revenue-generating applications, reselling data, or integrating into paid products) requires prior written approval. Contact us at api@cardinkum.com.au to discuss licensing.
  • When requesting an API key, you must declare your intended purpose of use. Misrepresenting your use case may result in key revocation.
  • Rate limits:
    • Without API key (IP-based): 100 requests per day
    • With API key (authenticated): 1,000 requests per day
    Exceeding limits may result in temporary suspension of API access.
  • Attribution required. When displaying Cardinkum data to end users, you must include visible attribution such as "Data by Cardinkum" or "Source: cardinkum.com.au".
  • Prohibited API uses include:
    • Reselling or relicensing raw data from the API without approval
    • Building competing vehicle data products that republish our database without transformation
    • Automated bulk downloading of the entire database
    • Using the API to train commercial AI models without prior written consent
    • Sharing API keys with third parties
  • We reserve the right to revoke API access for violations without notice.

4. User-contributed content

If you submit vehicle data, owner reports, corrections, or any other content to the Platform:

  • You grant Cardinkum a perpetual, worldwide, royalty-free licence to use, display, and distribute your submission as part of the Platform dataset.
  • You represent that your submission is accurate to the best of your knowledge.
  • You represent that you own or have the right to submit the content.
  • Submissions may be edited, corrected, or removed at our discretion to maintain data quality and accuracy.
  • Community submissions will typically be attributed as "Verified Australian Owner" to protect your privacy.

5. Intellectual property

What we own: The database structure, compilation, presentation, platform design, methodology, software, and brand are owned by Cardinkum Pty Ltd. These are protected by Australian copyright law.

What we don't own: Underlying vehicle specifications are factual data sourced from public sources (manufacturer websites, government databases). Facts themselves are not copyrightable. We rely on clean-room, independent sourcing from public information.

The Cardinkum name, logo, and wordmark are trademarks of Cardinkum Pty Ltd. You may not use them without written permission.

6. Paid products

Some Platform features (e.g., EV Match Reports) require payment. By purchasing:

  • You agree to the price and terms displayed at the point of purchase.
  • Digital products are delivered immediately and are non-refundable once delivered, unless the product is defective.
  • Payment is processed by Stripe. Stripe's terms of service apply to payment transactions.

7. Limitation of liability

To the maximum extent permitted by Australian law, Cardinkum Pty Ltd and its officers, employees, and contractors are not liable for:

  • Any direct, indirect, incidental, or consequential loss arising from your use of the Platform
  • Decisions made based on data or reports provided by the Platform
  • Interruption, suspension, or discontinuation of the Platform
  • Errors, inaccuracies, or omissions in data

Nothing in these Terms excludes any consumer guarantee or right that cannot be excluded under the Australian Consumer Law.

8. Termination

We reserve the right to suspend or terminate your access to the Platform at any time for violation of these Terms. You may stop using the Platform at any time.

9. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

10. Changes to these terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
